Terms and Conditions

2. Scope

These terms govern the booking of lessons, courses, equipment rental, tours, eFoil sessions, experiences, camps and group activities at El Niño Surf Center, whether booked at our centre, by phone, WhatsApp, email or through the online shop elninomallorca.com. Purchases of products in the online shop are governed by its own terms and conditions of sale. By making a booking, the customer confirms having read and accepted these terms.

3. Bookings and payment

• All prices include VAT.
• A booking is confirmed on payment of a 50 % deposit of the total price.
• The remaining 50 % must be paid no later than 7 days before the start of the activity.
• Bookings made less than 7 days in advance are paid in full at the time of booking.
• Bookings made through the online shop may be paid in full at the time of purchase.
• Payment methods: card, bank transfer, cash at our centre or payment link. In the online shop, Bizum and PayPal are also available.

4. Cancellations by the customer

• More than 7 calendar days before the start: 100 % refund.
• Between 7 days and 48 hours before: 50 % refund of the total booking price.
• Less than 48 hours before: no refund.
• No-show: no refund.
• If you arrive late, the activity ends at the scheduled time, with no compensation for the time lost.

These terms apply equally to groups, schools, companies and camps. Refunds are made using the original payment method within a maximum of 14 days. As these are leisure services provided on a specific date, the right of withdrawal does not apply (Art. 103(l) of the Spanish Consumer Protection Act, TRLGDCU).

5. Weather and safety

El Niño Surf Center decides whether wind, sea and weather conditions allow the activity to be carried out safely. If the activity cannot take place for this reason, the customer may choose between a new date at no cost or a full refund of the amount paid. For group activities, the decision is made 12 hours in advance.

6. Gift vouchers and hour packs

• All vouchers, whatever their purchase date, are valid until 15 September 2027 (inclusive). No vouchers are issued with validity beyond that date.
• Hours or sessions not used within the validity period are lost, with no right to a refund.
• Vouchers are non-refundable and cannot be exchanged for cash. They must be booked in advance, subject to availability.
• Exception: vouchers bought online without an assigned date may be returned within 14 calendar days of purchase, provided they have not been used.

7. Equipment rental

• Some equipment (for example wingfoil, or eFoil without an instructor) can only be rented after taking lessons with us or demonstrating sufficient experience. We may refuse a rental for safety reasons.
• An ID document and a deposit may be requested, depending on the equipment.
• The customer agrees to use the equipment with due care, follow the staff’s instructions and return it at the agreed time.
• Damage caused by misuse or negligence, and loss of equipment, will be charged to the customer at the cost of repair or replacement. The deposit covers up to its amount and any excess may be claimed. Normal wear and tear is not charged.

8. Requirements and safety

• You must be able to swim.
• The customer must report any health condition that may affect the activity.
• Instructors’ directions must be followed at all times.
• Minors need the authorisation of a parent or legal guardian. The minimum age for each activity is shown on its page.
• We may refuse participation, without refund, to anyone under the influence of alcohol or other substances, or who endangers their own safety or that of others.

9. Risks

Water sports involve inherent risks, which the customer knows and accepts. Nothing in these terms limits the liability of El Niño Mallorca, S.L. where the law does not allow it to be limited.

10. Data protection

We process your data in accordance with our Privacy Policy.

11. Complaints and governing law

Official complaint forms are available at our centre. You can also write to info@elninomallorca.com. El Niño Mallorca, S.L. is not a member of any consumer arbitration system or alternative dispute resolution body. These terms are governed by Spanish law. If you are a consumer, the courts of your place of residence have jurisdiction.

In the event of any discrepancy between language versions, the Spanish version prevails.
