Purpose. This website provides information about the water sports activities, courses, rentals and services of El Niño Surf Center and allows booking requests. Bookings are governed by our Terms and Conditions.

Intellectual property. The texts, photographs, logos and design of this website belong to El Niño Mallorca, S.L. or are used under licence. Reproduction, distribution or modification without express permission is prohibited.

Liability. We aim to keep the information on this website accurate and up to date, but we are not liable for occasional errors or for the content of third-party websites linked from here.

Governing law. This legal notice is governed by Spanish law.

Purposes and legal basis

• Answering enquiries you send us via form, email, phone or WhatsApp. Legal basis: your consent.
• Managing bookings, providing the services booked and issuing invoices. Legal basis: performance of a contract and compliance with legal obligations.
• Sending you our newsletter with news and offers. Legal basis: your consent, which you can withdraw at any time via the unsubscribe link in every email.
• Managing your club registration. Legal basis: your consent.
• Managing job applications you send us. Legal basis: your consent.

Retention

• Enquiries: for as long as needed to answer them.
• Customers: for the duration of the relationship and then for the legally required periods (6 years for commercial records and 4 years for tax records).
• Newsletter and club: until you withdraw your consent.
• Job applications: 1 year.

Recipients

We do not share your data with third parties unless required by law. The providers we need to deliver our services have access to it as data processors: web hosting (IONOS, servers in the European Union), newsletter delivery (Brevo – Sendinblue SAS, France) and our tax and accounting advisers. Payments in the online shop are processed by Redsys and PayPal. If you contact us via WhatsApp, that service is provided by WhatsApp Ireland Ltd. (Meta) under its own privacy policy.

Your rights

You can exercise your rights of access, rectification, erasure, objection, restriction of processing and portability, and withdraw your consent, by writing to info@elninomallorca.com or to our postal address, stating the right you wish to exercise. If you believe your request has not been handled properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

Minors

Personal data of children under 14 is only processed with the consent of a parent or legal guardian.

Security

We apply appropriate technical and organisational measures to protect your data against loss, misuse or unauthorised access.
